These Terms and Conditions govern your access to and use of the Xfitconnect website, application, and related services, including fitness challenges, leaderboards, integrations, and community features. By accessing or using Xfitconnect, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

1. About Xfitconnect

Xfitconnect provides digital fitness and wellness experiences, including but not limited to:

• activity-based challenges
• clubs and communities
• leaderboards and progress tracking
• integrations with third-party fitness services
• public and private challenge participation

We may update, improve, suspend, or discontinue any part of the service at any time.

2. Eligibility

You must use Xfitconnect only in compliance with applicable laws and these Terms and Conditions. If you are using the service on behalf of an organization, club, or company, you confirm that you are authorized to do so.

If you are under the age required by applicable law to enter into a binding agreement, you may use the service only with the consent and supervision of a parent, guardian, or authorized representative.

3. User Accounts

You are responsible for:

• providing accurate account information
• maintaining the confidentiality of your login credentials
• all activity that occurs through your account

You agree not to share your account in a misleading or unauthorized manner, impersonate another user, or create accounts for fraudulent or abusive use.

4. Integrations with Third-Party Services

Xfitconnect may allow you to connect with third-party services such as Strava, Garmin, Apple Health, or similar platforms.

By connecting a third-party account, you authorize Xfitconnect to access and process permitted data from that provider for the purposes of delivering the service.

You acknowledge that:

• third-party services operate under their own terms and privacy policies
• availability and accuracy of imported activity data depend on those providers
• delays, edits, missing records, or disconnected accounts may affect results, scoring, or leaderboard positions

xFitConnect is not responsible for outages, errors, access restrictions, or policy changes imposed by third-party platforms.

5. Challenge Participation and Fair Use

When participating in challenges, you agree to act fairly and honestly.

You must not:

• submit fraudulent, manipulated, or misleading activity data
• misuse device settings, integrations, or manual entries to gain unfair advantage
• interfere with challenge systems, scoring, or other users’ participation
• use the platform in a way that is abusive, harmful, or unlawful

Xfitconnect and challenge organizers reserve the right to review, adjust, reject, or remove activities, scores, results, or participants where misuse, technical inconsistency, or rule violations are suspected.

6. Organizer Responsibilities and Representations

If you create, host, manage, or publish a challenge, event, club, or other organizer-led experience on Xfitconnect, you agree to provide true, accurate, current, and complete information about yourself, your organization, and the challenge you are offering.

This includes, where applicable:

• organizer or organization name
• challenge details and schedule
• rules and participation requirements
• applicable fees or charges
• rewards, prizes, or deliverables
• valid participant-facing contact information

Organizers must include contact details in the challenge information so that participants can reach out directly regarding challenge-specific questions, logistics, fees, support, updates, cancellations, refunds, or other event-related concerns.

Xfitconnect may perform reasonable checks or due diligence on organizer submissions in good faith and to the best of our abilities. However, Xfitconnect does not guarantee independent verification of every organizer identity, representation, statement, or commitment, and organizers remain solely responsible for the accuracy and legitimacy of the information they provide.

Organizers are also responsible for communicating clearly and acting fairly toward participants, including with respect to challenge rules, updates, cancellations, pricing, and refunds where applicable.

7. Health and Safety

Xfitconnect is a technology platform, not a medical, fitness, or coaching provider.

Participation in physical activity carries inherent risk. You are solely responsible for your own health, training choices, physical condition, and participation decisions. You should consult a qualified medical professional before starting any exercise program or challenge, especially if you have any existing medical condition or concern.

You agree that xFitConnect is not liable for injuries, illness, or health outcomes arising from participation in activities, events, or challenges connected with the service.

8. Payments and Purchases

Some Xfitconnect features, subscriptions, or challenge registrations may be paid.

Where payment is required:

• prices and billing terms will be shown at the time of purchase
• you agree to provide valid payment information
• charges may be processed by third-party payment providers

All payment-related matters are also subject to our Refund Policy.

9. Intellectual Property

All content, branding, software, design, text, graphics, and functionality made available through Xfitconnect are owned by Xfitconnect or its licensors, unless otherwise stated.

You may not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit any part of the service except as permitted by law or with prior written permission.

10. User Content

If you upload images, text, comments, challenge content, club information, or other material to Xfitconnect, you retain ownership of your content, but you grant Xfitconnect a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and use that content for operating, improving, and promoting the service.

You are responsible for ensuring that your content:

• is accurate where relevant
• does not infringe any third-party rights
• is not unlawful, abusive, defamatory, or misleading

We may remove content that violates these Terms and Conditions or is otherwise harmful to the service or its users.

11. Availability and Technical Limitations

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability.

Xfitconnect may experience downtime, maintenance periods, integration delays, sync issues, scoring corrections, or feature changes. Leaderboards, challenge results, and displayed metrics may be updated, recalculated, or corrected where necessary.

12. Suspension or Termination

We may suspend, restrict, or terminate access to Xfitconnect at any time if we reasonably believe that:

• these Terms and Conditions have been violated
• the service is being misused
• continued access could create security, legal, or operational risk

You may stop using the service at any time. If you wish to delete your account, please refer to our Account Deletion page.

13. Limitation of Liability

To the fullest extent permitted by applicable law, xFitConnect and its affiliates, officers, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, business opportunity, or participation outcomes arising from or related to your use of the service.

Where liability cannot be excluded by law, our liability shall be limited to the amount paid by you, if any, for the relevant service giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless Xfitconnect and its affiliates, officers, employees, contractors, and partners from any claims, losses, liabilities, damages, costs, or expenses arising from:

• your use of the service
• your violation of these Terms and Conditions
• your content
• your violation of any rights of another person or entity

15. Changes to These Terms

We may update these Terms and Conditions from time to time. Updated versions will be posted on this page with a revised effective date. Your continued use of xFitConnect after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

Any dispute, claim, controversy, or proceeding arising out of or relating to Xfitconnect, these Terms and Conditions, or your use of the service shall be subject to the exclusive jurisdiction of the competent courts located in Noida, Uttar Pradesh, India. For administrative clarity, this includes courts having jurisdiction over matters arising in Gautam Buddha Nagar district, Uttar Pradesh.

By using Xfitconnect, you agree that Noida, Uttar Pradesh shall be the exclusive forum and venue for resolution of such disputes, subject to applicable law.
